TERMS AND CONDITIONS
The following Terms and conditions for online auctions shall always apply. Participants must agree to these terms and conditions in order to participate, otherwise they would be denied participation. conducted TAMBAZA ONLINE AUCTION. By registering to participate in Tambaza Auction Mart and General Brokers Limited online auctions, one must agree to these terms and conditions. Note that, these terms and conditions are supplemental, meaning that they shall apply in addition to the general conditions as stipulated in the auctioneers Act (CAP 227) 1928 (RE 1930 and 1994)
a) Bidders must register themselves before bidding
b) Bidders must have a National Identification or a NIDA Number.
c) Using another persons’ ID or NIDA Number is strictly forbidden.
d) To register the bidder must click on “register” to start registration process.
e) Binders already registered (for previous auction online need not register again).
f) A commitment fee of Tshs 100,000/= shall be paid up front before starting to bid. This amount of
money shall form part of the purchase price if the bidder is successful. Otherwise, the commitment fee shall
not be refunded, but it will be used the next time the bidder wants to participate in the auction. This condition
is put in place to discourage jokers who are bent on spoiling the auctions.,
g) Tambaza Auction Mart and General Brokers Limited shall not give warranty on the quality, quantity
or any other particulars for items/assets/goods offered for sale as such item is auctioned AS -IS and that
request for replacement or refund shall not be accepted. Items are auctioned AS-1S.
h) A non-refundable deposit of 25% of the bid price shall be paid at the end of the auction for successful
bids. The balance of 75% shall be paid within 48 hours after the sale for large assets (for landed properties
motor vehicles and machinery).
i) Where the balance of 75% is not paid as specified, the bid shall lapse and the lot in respect of which
the balance is outstanding shall be offered for sale at the next auction.
j) Goods purchased at an auction shall be collected within three (3) working days, and where the
purchaser fails to collect the goods, the purchaser shall be liable to the storage charges per day of stay and
other charges with effect from the date of sale up to the date of removal.
k) Where the purchased assets are not collected by t6he date of the next auction, they may be re
offered for sale at that auction, and the original purchaser may claim a refund of the purchase price less: –
a) The non-refundable deposit of twenty-five percent (25%).
b) Storage charges depending on the number of days.
c) The difference between the first and second prices, where the latter is lower than the original
purchase price.
l) Tambaza online auction shall not be responsible for any damage that occurs to the assets during the
removal by the purchaser or his representative or agent.
m) If a winner fails to pay within the prescribed time above, this winner will be black listed as a defaulter
and the winner’s registration will be deactivated.
n) For claiming items bought, the winner shall present: –
i A valid copy of paid payment bill and a bank receipt.
ii A proper identification such as national ID, passport or valid driver’s license.
o) Third part claims shall not be entertained.
p) Officers of Tambaza Auction Mart and General Brokers Limited are excluded from participating in this
auction.
q) Owners of Auctioned items are not allowed to participate in the Auction of his assets.
r) By submitting a bid, the bidder undertakes to abide by the terms and conditions of this auction.
s) Tambaza Auction online reserve the right to cancel/withdraw the auction at any time, when need be,
in accordance with the laws, rules and regulations governing the auction process.
t) Bidders are strictly warned of any malpractice which includes but not limited to feeding wrong information
to the auction online system, failing to pay the bid amount upon winning the bid within the prescribed
period. Failure to abide to this condition might be taken to be a sabotage, and is a serious crime.
u) Terms and conditions of this auction are to be carefully considered by an interested person before
acceptance and bidder registration.
